Terms of Service

These Terms of Service ("Terms") govern your use of Earmark, a service operated by Square Coast LLC ("Earmark," "we," "us"). Earmark lets you send article links or text by SMS and turns them into audio episodes in a private podcast feed (the "Service"). By signing up for or using the Service, you agree to these Terms.

1. Your account

Your mobile phone number is your Earmark account. You must be at least 18 years old, or the age of majority where you live, and you must be the account holder or authorized user of the phone number you sign up with. You're responsible for activity that comes from your phone number.

2. SMS program terms

Program name: Earmark.

Program description: After you sign up, you can text article links or article text to Earmark. Earmark replies to confirm each link it receives and again when the episode has been added to your private podcast feed. We may also send occasional account and service notices, such as your welcome message with your feed link. Earmark doesn't send marketing or promotional texts.

Message frequency: Varies based on how many links you send, usually 2 messages per link.

Costs: Message and data rates may apply depending on your mobile phone plan.

Opt out: Text STOP to the Earmark number at any time to stop receiving messages. We'll send one message confirming you've been unsubscribed and won't text you again unless you sign up again.

Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of any purchase. See our Privacy Policy for how we handle your information; we don't share or sell your mobile number or SMS opt-in consent to third parties for their marketing.

3. Personal use only

The Service is for your personal, non-commercial listening. Your feed is private: don't publish it, submit it to podcast directories, or share it in a way that makes episodes publicly available. You may only submit content you have the right to access, and you're responsible for what you submit.

4. Acceptable use

You agree not to:

  • send spam, automated bulk requests, or content meant to overload the Service;
  • submit unlawful, harmful, or infringing content;
  • try to get around usage limits, access other people's feeds, or interfere with the Service's security; or
  • resell or redistribute the Service or the episodes it creates.

We set daily limits on how many items each account can submit, and we may change them.

5. Content and audio

Earmark uses automated tools, including AI, to extract, clean up, summarize introductions for, and convert article text to speech. Audio may contain mistakes, omissions, or mispronunciations, so don't rely on it where accuracy matters. Articles remain the property of their owners. We don't claim ownership of content you submit; you give us permission to process it only as needed to provide the Service to you.

6. Changes and termination

We may change, suspend, or discontinue the Service, or suspend accounts that break these Terms. You can stop using the Service at any time by texting STOP. We may update these Terms; if we make material changes we'll post the new version here and update the date above. Continuing to use the Service means you accept the updated Terms.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that every link can be processed.

8. Limitation of liability

To the fullest extent allowed by law, Earmark will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $50.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
